Agreement and operator
These Terms govern access to brooksideorganic.com and purchases from Brookside Organic. Last updated October 9, 2026. Our Return and Refund Policy, Shipping Policy and Payment Policy form part of the purchase terms; our Privacy Policy explains data practices. Mandatory consumer rights are preserved.

Eligibility and accounts
You must be of legal age to enter a binding purchase contract, or act with appropriate parental or guardian authorization. Supply accurate contact, delivery and payment information. If you create an account, protect your credentials and contact us about unauthorized activity. You are responsible for activity you authorize; this does not waive protections for unauthorized transactions.

Products and information
Our store offers sports and exercise accessories. Read each item description, dimensions, materials, included components and instructions before buying. A depicted background item is not included unless the description says so. Screen displays can affect perceived color. Images and general descriptions do not excuse a material mismatch or inaccurate product representation. Environmental or certification claims apply only when supported and expressly identified.

Orders availability and errors
An order confirmation acknowledges receipt of an order but does not guarantee acceptance or availability. Payment is subject to provider authorization and verification. We may reject or cancel an order for a legitimate reason, such as suspected fraud, inventory or pricing error, a shipping limitation or product restriction. We will notify you and promptly refund any amount collected for a canceled order. A corrected price does not authorize a higher charge without your agreement. We may reasonably limit quantities, subject to applicable law.

Prices and fulfillment
Prices, shipping charges and applicable taxes are disclosed before payment. Any promotion conditions must be stated before purchase. Processing and delivery estimates are described in the Shipping Policy. Changes to prices or policies apply prospectively and do not remove the terms or statutory protections applicable to an already accepted order.

Acceptable use and intellectual property
Do not misuse the site, attempt unauthorized access, interfere with security, send unlawful material or infringe others rights. Store content may be owned by us or licensed from third parties. You may use the site for legitimate shopping and personal reference; other reproduction or exploitation requires permission or an applicable legal exception. Third-party marks remain their owners property.

Reviews and submissions
If you submit a review or other public content, it must be truthful and lawful. You retain ownership and permit us to display and reasonably format it for the purpose for which you submitted it. We do not acquire a right to misrepresent your endorsement. Reviews may be moderated for genuine policy violations; we do not condition legitimate remedies on removing a negative review.

Third party services
Links, payment tools or other third-party features may have their own terms. Their availability does not transfer our responsibility for our own sales or representations. Review relevant provider terms before using optional services.

Product use and warranties
Read and follow all instructions, fit guidance, load limits, warnings and maintenance directions. Inspect equipment and stop using an item that is damaged, altered, recalled or no longer suitable. Sports, exercise and open-water activity involve risks that accessories cannot eliminate. Swimming tow buoys are visibility accessories, not life jackets. Product descriptions and any written warranty determine the express commitments offered; nothing excludes mandatory warranties, remedies or responsibility that cannot legally be excluded.

Liability and disputes
To the maximum extent permitted by law, we do not promise uninterrupted website access or outcomes beyond express product descriptions and warranties. For claims that may lawfully be limited, we exclude indirect or consequential losses and limit liability to the amount paid for the affected product or order. These limits do not apply to fraud, willful misconduct, personal injury or any statutory right or liability that cannot legally be limited. Applicable law determines governing law and the courts with jurisdiction; your access to lawful courts and remedies is preserved. You may contact support to seek a resolution without giving up lawful complaint or claim rights.

Changes and severability
If a provision is unenforceable, the remainder applies to the extent lawful. Material changes are posted with a new effective date and any notice required by law. Changes do not retroactively remove accrued rights or alter an existing purchase without a lawful basis.
